2011年2月1日,黃某應聘到某公司從事辦公室文員工作。雙方簽訂了期限自2011年2月1日至2013年1月31日的勞動合同。合同約定,黃某月工資為1800元,實行綜合計算工時工作制,工作時間的計算周期為年。1年間,該公司要求黃某加班110小時,休息日加班15天,節假日加班2天,共計工作小時數為1920小時。2012年1月31日,黃某以公司未發放加班費為由提出解除勞動合同,并訴至當地勞動人事爭議仲裁機構,要求公司支付加班費4686.21元和解除勞動合同的經濟補償1800元。
公司認為,黃某在履行勞動合同的1年中,工作小時數為1920小時,未超過法定的2000小時的工作時間,因為黃某實行的是以年為周期的綜合計算工時工作制,不存在加班加點的情況,故不應支付黃某加班費。黃某要求公司出示勞動保障行政部門出具的其崗位實行綜合計算工時工作制的批準文件。公司稱此為雙方約定,無需批件。本案經調解無果,仲裁委裁決支持了黃某的仲裁請求。
