全國總工會公布:2014年度勞動違法典型案件

     編者按:在《勞動法》施行20周年之際,中華全國總工會專門梳理了2014年我國勞動關系領域的違法案件和勞動事件,并從中挑選10起具有典型意義的案例進行集中公布。

  全總法(fa)(fa)(fa)律(lv)(lv)工作(zuo)部負責人表示(shi),從目前(qian)我國勞(lao)(lao)(lao)動(dong)關系發(fa)(fa)展現狀看,用人單位違(wei)反勞(lao)(lao)(lao)動(dong)法(fa)(fa)(fa)律(lv)(lv)侵害職(zhi)工合法(fa)(fa)(fa)權(quan)益的案件(jian)事(shi)件(jian)還大(da)量存在,有的案件(jian)事(shi)件(jian)性質非(fei)常惡(e)劣,社會影(ying)響極(ji)(ji)壞,對勞(lao)(lao)(lao)動(dong)關系和(he)(he)社會穩定(ding)造成很大(da)負面影(ying)響。推動(dong)勞(lao)(lao)(lao)動(dong)法(fa)(fa)(fa)律(lv)(lv)貫徹實施,維護職(zhi)工合法(fa)(fa)(fa)權(quan)益,發(fa)(fa)展和(he)(he)諧勞(lao)(lao)(lao)動(dong)關系,工會應發(fa)(fa)揮積極(ji)(ji)作(zuo)用,進一(yi)步加強勞(lao)(lao)(lao)動(dong)法(fa)(fa)(fa)律(lv)(lv)監(jian)督(du),借助媒體力量,推動(dong)形成有利于(yu)勞(lao)(lao)(lao)動(dong)法(fa)(fa)(fa)律(lv)(lv)實施和(he)(he)職(zhi)工權(quan)益維護的輿(yu)論氛圍。

  NO.1 浙江新東方烹飪學校侵犯女性平等就業權

  河南籍應(ying)屆(jie)女大(da)學(xue)生郭某(mou)在應(ying)聘新東方烹(peng)飪(ren)(ren)學(xue)校(xiao)(xiao)文案(an)(an)職位(wei)(wei)時(shi),多次因烹(peng)飪(ren)(ren)學(xue)校(xiao)(xiao)“限招(zhao)男性”的招(zhao)聘條件被拒(ju)。2014年7月(yue)8日(ri),郭某(mou)向杭州(zhou)市西湖區人民法(fa)院(yuan)(yuan)提起訴訟。9月(yue)10日(ri),法(fa)院(yuan)(yuan)公開(kai)審理(li)了(le)此案(an)(an),11月(yue)12日(ri),法(fa)院(yuan)(yuan)作(zuo)出判決,認(ren)為(wei)烹(peng)飪(ren)(ren)學(xue)校(xiao)(xiao)文案(an)(an)職位(wei)(wei)不屬(shu)于法(fa)定(ding)(ding)女性禁忌(ji)勞動范圍,烹(peng)飪(ren)(ren)學(xue)校(xiao)(xiao)未對(dui)郭某(mou)是否符(fu)合招(zhao)聘條件進行(xing)審查(cha),而僅以(yi)崗位(wei)(wei)限招(zhao)男性為(wei)由拒(ju)絕錄用郭某(mou)的事實成立。根據勞動法(fa)、就(jiu)(jiu)業促進法(fa)等法(fa)律的規定(ding)(ding),認(ren)定(ding)(ding)烹(peng)飪(ren)(ren)學(xue)校(xiao)(xiao)行(xing)為(wei)屬(shu)于就(jiu)(jiu)業性別歧視,侵犯了(le)郭某(mou)的平等就(jiu)(jiu)業權,給郭某(mou)造成了(le)一定(ding)(ding)的精神損(sun)害(hai),應(ying)向郭某(mou)賠償精神損(sun)害(hai)撫(fu)慰金2000元。

  NO.2 深圳可立克科技股份有限公司、德林克電子有限公司非法使用童工

  2013年底,深圳(zhen)市可(ke)立克(ke)科技股(gu)份(fen)有限公(gong)(gong)(gong)(gong)司(si)、德(de)林克(ke)電(dian)子有限公(gong)(gong)(gong)(gong)司(si)因(yin)非(fei)(fei)法使用(yong)童工(gong)被媒體舉報(bao)。2014年初(chu),經相關部門調(diao)查(cha)核實,兩(liang)公(gong)(gong)(gong)(gong)司(si)73名四川(chuan)涼(liang)山籍彝(yi)族員工(gong)中,未滿16周歲童工(gong)9人(ren),其(qi)中可(ke)立克(ke)公(gong)(gong)(gong)(gong)司(si)使用(yong)2人(ren)、德(de)林克(ke)公(gong)(gong)(gong)(gong)司(si)使用(yong)7人(ren)。2014年1月(yue)3日(ri)(ri),深圳(zhen)市寶安區人(ren)社部門對兩(liang)公(gong)(gong)(gong)(gong)司(si)非(fei)(fei)法使用(yong)童工(gong)等違法行為發(fa)出勞動(dong)監察限期整改指(zhi)令書,1月(yue)10日(ri)(ri)和(he)14日(ri)(ri),分別對可(ke)立克(ke)公(gong)(gong)(gong)(gong)司(si)、德(de)林克(ke)公(gong)(gong)(gong)(gong)司(si)處以1萬(wan)元和(he)3.5萬(wan)元的行政(zheng)罰款。

  NO.3 安徽青山水電設備安裝有限公司拒絕與勞動者簽訂書面勞動合同

  安徽青山水電設(she)備(bei)安裝有(you)限(xian)公(gong)司(si)(si)于(yu)2013年8月1日(ri)與(yu)胡(hu)某(mou)建立勞(lao)(lao)動(dong)(dong)關系。公(gong)司(si)(si)每(mei)月向(xiang)胡(hu)某(mou)支(zhi)付(fu)工資(zi)2500元(yuan),但不與(yu)其簽訂書面(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong),也未(wei)給其繳納社會保險費(fei)。胡(hu)某(mou)與(yu)公(gong)司(si)(si)多次協商無果(guo),于(yu)2014年6月向(xiang)當(dang)地勞(lao)(lao)動(dong)(dong)爭議仲裁委員會申請(qing)仲裁。經審(shen)理裁定,公(gong)司(si)(si)因未(wei)與(yu)胡(hu)某(mou)簽訂書面(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong),應(ying)按照勞(lao)(lao)動(dong)(dong)合(he)同(tong)法有(you)關未(wei)簽勞(lao)(lao)動(dong)(dong)合(he)同(tong)支(zhi)付(fu)雙倍工資(zi)的(de)規定,另向(xiang)胡(hu)某(mou)支(zhi)付(fu)21774元(yuan)。

  NO.4 四川遂寧四堅建筑裝飾工程有限公司要求員工簽訂不平等承諾書

  2013年12月(yue),四(si)川遂(sui)寧(ning)四(si)堅建筑(zhu)裝飾工(gong)(gong)(gong)(gong)(gong)程有限公司(si)要求(qiu)員(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)簽(qian)署承(cheng)諾書,承(cheng)諾內容包括:員(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)無任(ren)何理(li)由拒絕公司(si)的(de)工(gong)(gong)(gong)(gong)(gong)作安排,包括工(gong)(gong)(gong)(gong)(gong)作上(shang)的(de)應酬接待也絕對服從;自(zi)愿(yuan)放棄(qi)星期(qi)天、節假日(春(chun)節除外(wai)),堅持下(xia)午不(bu)定時下(xia)班(ban);遲(chi)到一(yi)分鐘接受處罰130元(yuan);自(zi)愿(yuan)將每月(yue)實(shi)(shi)領工(gong)(gong)(gong)(gong)(gong)資的(de)30%押在公司(si),押滿2萬(wan)元(yuan)為止。該(gai)承(cheng)諾書引發員(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)普(pu)遍不(bu)滿,有員(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)在網上(shang)公開此事。當(dang)地(di)工(gong)(gong)(gong)(gong)(gong)會和(he)勞動監察部門得知(zhi)后(hou),前往該(gai)公司(si)調查,在確認網絡舉(ju)報情況屬實(shi)(shi)后(hou),向(xiang)公司(si)發出(chu)整改通知(zhi)書,要求(qiu)立即糾正違法行(xing)為。該(gai)公司(si)在一(yi)周內進行(xing)了整改,并承(cheng)諾今后(hou)不(bu)再要求(qiu)員(yuan)(yuan)工(gong)(gong)(gong)(gong)(gong)簽(qian)訂類似協(xie)議。

  NO.5 福建暢豐車橋制造有限公司違反最低工資標準的規定

  福建(jian)暢豐車橋(qiao)制造有(you)限公(gong)司于(yu)(yu)2002年5月與陳(chen)昌力建(jian)立勞動關系,安排陳(chen)從(cong)事裝卸工(gong)(gong)作,實(shi)行計件工(gong)(gong)資(zi)(zi)。從(cong)2013年3月起,因(yin)生產任務減少(shao),公(gong)司只給(gei)陳(chen)安排少(shao)量工(gong)(gong)作,但仍按(an)原計件標(biao)準(zhun)發放工(gong)(gong)資(zi)(zi),致使其月工(gong)(gong)資(zi)(zi)始終低于(yu)(yu)當地最(zui)低工(gong)(gong)資(zi)(zi)標(biao)準(zhun),最(zui)低時只有(you)90元/月。2014年3月,公(gong)司以陳(chen)沒(mei)有(you)打卡上班為由與其解除勞動合同。在當地工(gong)(gong)會(hui)的(de)幫助下,陳(chen)昌力向福建(jian)省龍巖市新羅(luo)區人(ren)民法院提起訴訟(song),法院判(pan)決公(gong)司向陳(chen)支付實(shi)發工(gong)(gong)資(zi)(zi)與最(zui)低工(gong)(gong)資(zi)(zi)標(biao)準(zhun)的(de)差額(e)。

   NO.6 陜西省宜君縣討薪農民工被毆打

  2014年(nian)11月,陜西長生建(jian)筑(zhu)勞(lao)務(wu)公(gong)(gong)司(si)(si)與分包施工(gong)(gong)(gong)(gong)的工(gong)(gong)(gong)(gong)程隊因拖欠(qian)100余名(ming)農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)問題發生了爭議。經宜君(jun)縣相關行政部(bu)門(men)協調,長生建(jian)筑(zhu)勞(lao)務(wu)公(gong)(gong)司(si)(si)承諾盡快(kuai)發放農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)。11月7日在工(gong)(gong)(gong)(gong)資(zi)發放現場,長生建(jian)筑(zhu)勞(lao)務(wu)公(gong)(gong)司(si)(si)宜君(jun)西園(yuan)小(xiao)區項目部(bu)負責人許磊授意(yi)司(si)(si)機(ji)胡某,糾集30余名(ming)社會閑散人員,對準(zhun)備(bei)領取(qu)工(gong)(gong)(gong)(gong)資(zi)的20多名(ming)農民(min)工(gong)(gong)(gong)(gong)進行棍棒(bang)毆打,并限制其人身(shen)自由,導致多名(ming)農民(min)工(gong)(gong)(gong)(gong)被(bei)打傷(shang)。15日,許磊因涉嫌(xian)非法拘(ju)禁罪被(bei)刑事拘(ju)留(liu)。18日,銅川市、宜君(jun)縣相關部(bu)門(men)及(ji)工(gong)(gong)(gong)(gong)程承建(jian)單位向農民(min)工(gong)(gong)(gong)(gong)足(zu)額發放欠(qian)薪(xin)232萬元,并為(wei)受傷(shang)農民(min)工(gong)(gong)(gong)(gong)墊付了醫療費。

  NO.7 江蘇昆山中榮金屬制品有限公司發生重大安全生產責任事故

  2014年8月2日,江(jiang)蘇昆山臺資企業中榮(rong)金屬制品有限(xian)公司(si)(si)發(fa)生(sheng)爆(bao)(bao)炸(zha)事(shi)(shi)故(gu),至國務(wu)院(yuan)針對(dui)事(shi)(shi)故(gu)調(diao)查報(bao)告作(zuo)出批復為止,共造(zao)成146人(ren)死亡。調(diao)查報(bao)告認為,事(shi)(shi)故(gu)直(zhi)接(jie)原因是事(shi)(shi)故(gu)車(che)間(jian)(jian)除塵系(xi)統(tong)較長(chang)時(shi)間(jian)(jian)未清理,鋁(lv)粉塵積(ji)聚(ju)。除塵系(xi)統(tong)風(feng)機開啟后,打(da)磨過程產生(sheng)的高溫(wen)顆粒在集塵桶(tong)(tong)上(shang)方形成粉塵云(yun)(yun)。1號除塵器集塵桶(tong)(tong)銹蝕破(po)損,桶(tong)(tong)內鋁(lv)粉受(shou)潮,發(fa)生(sheng)氧(yang)化放(fang)熱反應,達到粉塵云(yun)(yun)的引(yin)燃溫(wen)度,引(yin)發(fa)除塵系(xi)統(tong)及(ji)車(che)間(jian)(jian)的系(xi)列爆(bao)(bao)炸(zha)。因沒有泄爆(bao)(bao)裝置(zhi),爆(bao)(bao)炸(zha)產生(sheng)的高溫(wen)氣體(ti)和(he)燃燒物(wu)瞬間(jian)(jian)經除塵管(guan)道從(cong)各吸(xi)塵口噴出,導(dao)致全車(che)間(jian)(jian)所有工位操(cao)作(zuo)人(ren)員直(zhi)接(jie)受(shou)到爆(bao)(bao)炸(zha)沖擊,造(zao)成群(qun)死群(qun)傷。目前,對(dui)涉嫌犯罪的中榮(rong)公司(si)(si)董事(shi)(shi)長(chang)吳基滔、總經理林伯昌(chang),昆山開發(fa)區管(guan)委會副(fu)主(zhu)任陳(chen)藝等(deng)18名責任人(ren)已送(song)司(si)(si)法機關(guan)采取措施;對(dui)江(jiang)蘇省(sheng)副(fu)省(sheng)長(chang)史(shi)和(he)平(ping)等(deng)其他35名責任人(ren)給(gei)予(yu)(yu)相應的黨紀(ji)、政紀(ji)處(chu)分(fen);對(dui)江(jiang)蘇省(sheng)政府予(yu)(yu)以通(tong)報(bao)批評(ping),并責令其向(xiang)國務(wu)院(yuan)作(zuo)出深刻檢討。

  NO.8 江蘇鵬越電子科技有限公司辭退懷孕女工

  2012年初,江蘇鵬越電子科技有(you)(you)限(xian)公司聘(pin)用周女士擔任(ren)公司行(xing)(xing)政秘書(shu)。2014年周女士懷(huai)孕(yun)后(hou),公司以(yi)企(qi)業(ye)(ye)(ye)效(xiao)益不好、歇業(ye)(ye)(ye)整頓為由,告知(zhi)周女士暫時(shi)(shi)回家休息,等待復(fu)工通(tong)知(zhi)。與周女士同(tong)時(shi)(shi)離開公司等待復(fu)工的,還有(you)(you)另外兩名(ming)懷(huai)孕(yun)女工。此后(hou),公司并(bing)未(wei)通(tong)知(zhi)三名(ming)懷(huai)孕(yun)女工復(fu)工,卻(que)要求她們遞交(jiao)辭職報告,否則將把她們安排到體力勞(lao)動(dong)繁重的一(yi)線生產(chan)崗位。三名(ming)懷(huai)孕(yun)女工為維護(hu)自身合法權益,先后(hou)向當地總工會、婦(fu)聯、勞(lao)動(dong)監察(cha)等部(bu)門反映情況。勞(lao)動(dong)監察(cha)部(bu)門先后(hou)向企(qi)業(ye)(ye)(ye)下達了限(xian)期改(gai)正指(zhi)令書(shu)、行(xing)(xing)政處理決(jue)定書(shu)、行(xing)(xing)政處罰決(jue)定書(shu),但(dan)企(qi)業(ye)(ye)(ye)仍不改(gai)正辭退懷(huai)孕(yun)女工的違法行(xing)(xing)為。目前,勞(lao)動(dong)保障監察(cha)部(bu)門已申請法院強制(zhi)執行(xing)(xing)。

  NO.9 黑龍江哈爾濱百事可樂有限公司違法解除工會主席勞動合同

  2014年12月(yue)(yue)1日(ri),哈爾(er)(er)(er)濱(bin)百(bai)事可樂有(you)限(xian)公(gong)司(si)(si)(si)(si)下調員工(gong)采暖(nuan)(nuan)費(fei)發(fa)放(fang)標準,引發(fa)員工(gong)不滿。12月(yue)(yue)3日(ri),公(gong)司(si)(si)(si)(si)工(gong)會(hui)(hui)(hui)主(zhu)(zhu)席向康控東北區(qu)(qu)總(zong)(zong)部(bu)反(fan)映員工(gong)意見(jian),建議公(gong)司(si)(si)(si)(si)繼續(xu)執行(xing)原采暖(nuan)(nuan)費(fei)發(fa)放(fang)標準。12月(yue)(yue)5日(ri),康控東北區(qu)(qu)總(zong)(zong)部(bu)在未對員工(gong)意見(jian)予以回(hui)復的情(qing)況下,以“工(gong)作(zuo)理(li)(li)念(nian)(nian)與公(gong)司(si)(si)(si)(si)理(li)(li)念(nian)(nian)不相容”為由,向哈爾(er)(er)(er)濱(bin)百(bai)事可樂公(gong)司(si)(si)(si)(si)工(gong)會(hui)(hui)(hui)主(zhu)(zhu)席下發(fa)了(le)單方面(mian)解除(chu)勞動(dong)(dong)合同的通知。12月(yue)(yue)8日(ri),該工(gong)會(hui)(hui)(hui)主(zhu)(zhu)席向哈爾(er)(er)(er)濱(bin)市外商投資企業工(gong)會(hui)(hui)(hui)工(gong)作(zuo)委員會(hui)(hui)(hui)投訴。隨后,哈爾(er)(er)(er)濱(bin)市總(zong)(zong)工(gong)會(hui)(hui)(hui)啟(qi)動(dong)(dong)了(le)法律援(yuan)助程序(xu),支持工(gong)會(hui)(hui)(hui)主(zhu)(zhu)席依法維權。經與哈爾(er)(er)(er)濱(bin)百(bai)事可樂公(gong)司(si)(si)(si)(si)交涉,該公(gong)司(si)(si)(si)(si)承認解除(chu)勞動(dong)(dong)合同行(xing)為不當,并(bing)撤銷了(le)解除(chu)勞動(dong)(dong)合同的決(jue)定(ding)。

  NO.10 廣東東莞裕元鞋廠少繳社會保險費

  2014年3月(yue)(yue),廣(guang)(guang)東(dong)東(dong)莞裕元鞋廠部分工(gong)(gong)人(ren)查(cha)詢(xun)社(she)(she)(she)(she)(she)保繳(jiao)費(fei)記錄時發現,廠方(fang)為其繳(jiao)納社(she)(she)(she)(she)(she)保費(fei)的(de)(de)(de)比例明顯低于(yu)當(dang)地(di)規定的(de)(de)(de)標準,導致社(she)(she)(she)(she)(she)保待遇(yu)大(da)幅(fu)縮水。4月(yue)(yue)5日(ri),數千名工(gong)(gong)人(ren)聚集,抗議工(gong)(gong)廠少繳(jiao)社(she)(she)(she)(she)(she)會保險(xian)費(fei)的(de)(de)(de)行為。4月(yue)(yue)14日(ri),廠方(fang)回應(ying),提(ti)(ti)(ti)出(chu)自5月(yue)(yue)起提(ti)(ti)(ti)高社(she)(she)(she)(she)(she)保繳(jiao)費(fei)率,但未(wei)提(ti)(ti)(ti)及補繳(jiao)社(she)(she)(she)(she)(she)保費(fei)和提(ti)(ti)(ti)高具體(ti)繳(jiao)費(fei)基(ji)數,從而引發了更(geng)大(da)規模的(de)(de)(de)萬人(ren)停工(gong)(gong)事件。4月(yue)(yue)21日(ri),廠方(fang)提(ti)(ti)(ti)出(chu)新方(fang)案,承諾補繳(jiao)社(she)(she)(she)(she)(she)保費(fei),并每人(ren)每月(yue)(yue)發放補貼230元。同日(ri),廣(guang)(guang)東(dong)省(sheng)市鎮三(san)級工(gong)(gong)會組成聯合組進(jin)駐該(gai)廠與(yu)工(gong)(gong)人(ren)溝通,為他(ta)們提(ti)(ti)(ti)供法(fa)律(lv)咨(zi)詢(xun)。東(dong)莞市社(she)(she)(she)(she)(she)會保障局根據調(diao)查(cha)情(qing)況,向(xiang)裕元鞋廠發出(chu)《社(she)(she)(she)(she)(she)會保險(xian)限期(qi)改正指令(ling)書》,責(ze)令(ling)其于(yu)4月(yue)(yue)25日(ri)前進(jin)行依法(fa)整改。
