非全日制用工未簽合同 無需支付雙倍工資

    2014年3月,小(xiao)王被山東某(mou)保潔公司招用,從事(shi)門窗、地(di)面(mian)的清(qing)潔工(gong)(gong)(gong)作(zuo),雙方(fang)口頭約定,小(xiao)王每(mei)天工(gong)(gong)(gong)作(zuo)4小(xiao)時,每(mei)小(xiao)時報酬15元,周六、周日休息,月底結清(qing)工(gong)(gong)(gong)資。2015年4月,小(xiao)王認為(wei)自己的工(gong)(gong)(gong)資偏(pian)低,要求(qiu)公司增加(jia)工(gong)(gong)(gong)資,公司不同意(yi),小(xiao)王遂向當地(di)勞動(dong)爭(zheng)議仲裁委員(yuan)會申訴,要求(qiu)公司增加(jia)工(gong)(gong)(gong)資,并支(zhi)付(fu)未(wei)簽訂書面(mian)勞動(dong)合同的雙倍工(gong)(gong)(gong)資。

  仲(zhong)裁委審(shen)理后(hou)認為,《勞動(dong)合同(tong)法》第(di)68條(tiao)規(gui)(gui)定:“非全日(ri)(ri)制(zhi)用(yong)(yong)(yong)工(gong),是指以小(xiao)(xiao)時(shi)(shi)計(ji)酬為主,勞動(dong)者在同(tong)一用(yong)(yong)(yong)人(ren)單位(wei)一般平均每(mei)日(ri)(ri)工(gong)作(zuo)時(shi)(shi)間(jian)不超(chao)(chao)過4小(xiao)(xiao)時(shi)(shi),每(mei)周工(gong)作(zuo)時(shi)(shi)間(jian)累計(ji)不超(chao)(chao)過24小(xiao)(xiao)時(shi)(shi)的(de)(de)用(yong)(yong)(yong)工(gong)形(xing)式。”第(di)69條(tiao)規(gui)(gui)定:“非全日(ri)(ri)制(zhi)用(yong)(yong)(yong)工(gong)雙方當事人(ren)可以訂立口頭協議(yi)。”該公司采用(yong)(yong)(yong)的(de)(de)是非全日(ri)(ri)制(zhi)用(yong)(yong)(yong)工(gong)形(xing)式,公司所(suo)在地的(de)(de)最低小(xiao)(xiao)時(shi)(shi)工(gong)資標準為13元(yuan),故公司與小(xiao)(xiao)王訂立口頭協議(yi),每(mei)小(xiao)(xiao)時(shi)(shi)支付其(qi)工(gong)資15元(yuan),符合法律規(gui)(gui)定,小(xiao)(xiao)王要求增加工(gong)資沒有(you)法律依據。勞動(dong)合同(tong)法規(gui)(gui)定的(de)(de)用(yong)(yong)(yong)人(ren)單位(wei)未簽訂書面勞動(dong)合同(tong)應(ying)支付雙倍(bei)工(gong)資,是針(zhen)對(dui)全日(ri)(ri)制(zhi)用(yong)(yong)(yong)工(gong)而言的(de)(de),不適用(yong)(yong)(yong)于(yu)非全日(ri)(ri)制(zhi)用(yong)(yong)(yong)工(gong)。因此,對(dui)小(xiao)(xiao)王的(de)(de)申(shen)訴請求,仲(zhong)裁委沒有(you)支持(chi)。(源于(yu)中(zhong)國普法網(wang))
